What Is Title Insurance and Why Is It Important?

Title Insurance is your protection policy against loss or defects on a specified property. Title Insurance policies protect you, the insured, from claims attached to the property prior to the time of ownership.

A detailed examination or title search of the public records is performed on the specified property to show any title defects and liens, as well as other encumbrances and restrictions, affecting a specific tract of land. Unpaid real estate taxes, unsatisfied mortgages, judgments against the current property owners, and any restrictions limiting the use of the land, are just a few examples. A title search is also done to insure that the current owner of record has a right to transfer ownership of the property with no outstanding liens, defects, or burdens on the property.

The most common problems that are covered by title insurance include fraud, forgery, judgments, unpaid taxes, liens, defective deeds, clerical errors within the public records, and mental incompetence. Any of these defects may jeopardize your ownership rights of the said property.

Charges for Title Insurance may vary, but are considered to be very reasonable as normally it is a non re-occurring fee at the time of closing.
